On November 16, 2020, the "Advocacy in International Arbitration" - 2020 Shanghai Arbitration Week Llinks Forum，hosted by Shanghai Bureau of Justice, Council for the Promotion of International Trade Shanghai and Shanghai Arbitration Association, was held online.
The forum was opened in a speech by Mr. David Yu, the President of Shanghai Arbitration Association, Mr. Kewei Zhong, the Director of Policy and Regulations Division of Shanghai State-owned Assets Supervision and Administration Commission, and Mr. Chenyao Xiong, the Executive Vice President of Shanghai Corporate Counsel Association. With the joint support of Llinks Shenzhen Office, Mr. Peiming Yang, a partner of Llinks law Offices, acted as the host.
Mr. Jingzhou Tao, an Independent Arbitrator, a member of the Expert Committee of International Commercial Tribunal of The Supreme People's Court of China, the Expert Advisory Committee of China International Economic and Trade Arbitration Commission, and International Expert Advisory Committee of Hong Kong International Arbitration Centre, shared the topic about "How to Conduct an Oral Hearing - from Arbitrator's Perspective". Mr. Tao mainly focused on the preparations for the hearing, the efficiency obligations of arbitrators, the rights of parties to obtain reasonable statements, the cross-examination of witnesses, the cross-examination of evidences, the liability for breach of contract and the amount of claims.
Mr. Patrick Zheng, shared a topic "How to Cross-examine Factual Witnesses in International Tribunal" around the differences between civil law and common law, the general trial procedures of International arbitration, the scope of cross-examination, guiding issues, and questioning witnesses.
Mr. David Wu, a Partner of Llinks, Vice Director of China Association for Sports Law, Arbitrator of Court of Arbitration for Sport, shared the "Unique Characteristics of Advocacy in International Sports Arbitration", mainly focusing on the overview of international sports dispute resolution system , internal relief —The International Sports Federations, external relief –– Court of Arbitration for Sport, and interim relief — CAS ad hoc arbitration, and the prospects of domestic sports arbitration system.
Mr. William M.F. Wong, Senior Counsel, Justice of the Peace, and the Chairman of the Board in Hong Kong Bar Association Arbitration Committee, shared "Witness Statements in International Arbitration", mainly including the drafting statements of key rebuttals, consistency of testimony from witnesses, and the problem of tone and determination of witness testimony.
The forum was successfully held and concluded in the warm discussions among participants.
