On 14 September, 2018, Llinks held the "2018 Business Intellectual Property Series Seminar (Intellectual Property, Antitrust, Labor)". Llinks Partner, Xun Yang, and Patrick Gu together with counsel Kevin Huang presided over the seminar and delivered speeches respectively. More than 30 well-known corporate general counsels registered and attended this seminar. This seminar is also one of the series of special activities of Llinks 20th anniversary.
The theme of the first half of the seminar was "When Intellectual Property Meeting Antitrust – a Legal Cross Filed that Affects Business Development." Xun Yang and Kevin Huang shared their first-hand experience in the cross domain of intellectual property and monopoly law. Mr. Yang gave a preliminary introduction to the legal system and competition relationship between intellectual property and anti-monopoly, explicating the specific abuse performance in monopoly and intellectual property. Mr. Huang analyzed the intellectual property issues involved in the concentration of undertakings, abuse of market dominance and monopoly agreements. The first half of the meeting ended with practical advice on managing antitrust risks. The guests exchanged their experiences on issues such as distribution replacement license fees, reciprocal patent development, and reverse licensing.
In the second half of the meeting, Patrick Gu and Xun Yang approached the subject of "Intellectual Property Management in Labor and Employment from the Angles of Employment, Management and Resignation". Mr. Yang discussed the pre-employment intellectual property risk management and on-the-job intellectual property protection and practices in making confidentiality agreements, payoffs and rewards for invention and creation. Mr. Gu shared the trial status of the competition restrictions cases in Beijing, Shanghai and Shenzhen, the difficulties and focus issues in the current non-competition cases. Combined with the actual experience of past agency cases, Mr. Gu also interpreted, how to more effectively protect the business secrets of enterprises, and how to establish and carry out competition restriction agreement. In addition, Patrick Gu conducted a key analysis of a recent competition restrictions case that everyone is concerned about. A hot discussion is followed between Llinks lawyers and guests at the end of meeting.
