On August 14, 2026, the "2026 Seminar on Hot Legal Issues in the Public Fund Industry," hosted by Llinks Law Offices and guided by the Shanghai Asset Management Association, was successfully held at the Grand Kempinski Hotel Shanghai. As an annual professional event continuously held by Llinks Law Offices since 2009, this 14th edition of the seminar continued the tradition of high quality. It invited over 100 public fund managers and asset management institutions, attracting nearly 200 industry professionals to gather and discuss cutting-edge legal topics in the industry.
The seminar received guidance and support from the Shanghai Asset Management Association. Mr. Kang Han, Secretary-General of the Shanghai Asset Management Association, attended the event to jointly explore new directions for the development of the asset management industry. Secretary-General Han expressed his expectation that professional service institutions in the industry work with the association to jointly contribute to the construction of Shanghai as a global asset management center.
The first keynote speech of the seminar was delivered by Llinks partner Ms. Sandra Lu, centering on the new dynamics of cross-border asset management business. Ms. Lu focused on the policy dividends and practical pathways of cross-border asset management, systematically outlining the new landscape of current cross-border business development, and provided attending institutions with reference guidelines that possess both strategic height and practical value. Ms. Lu pointed out that the key to the development of the asset management industry lies in aligning with high international standards. Such high standards are not only reflected in internationally accepted regulatory rules but also run through all aspects of the daily operations of international asset management institutions, such as corporate governance, business management, investment research systems, trade execution, back-office operations, and compliance risk control. With the continuous deepening of connectivity mechanisms, the two-way interaction between the "going global" of Chinese asset management institutions and the "bringing in" of foreign institutions is becoming increasingly frequent, and the demand for cross-border legal services will gradually expand from single product compliance to comprehensive cross-border governance support.
Subsequently, Llinks partner Mr. Desmond An provided an in-depth interpretation of the Administrative Measures for the Online Marketing of Financial Products, which has attracted widespread attention in the industry. Mr. An conducted a systematic analysis from multiple dimensions, including legislative background, core clauses, actual impacts on public fund managers, and compliance implementation plans. He pointed out that the new regulations put forward brand-new compliance requirements for fund companies' online marketing and promotion, channel management, and third-party cooperation, which will prompt fund companies to re-examine their existing marketing compliance systems. Mr. An's interpretation provided strong support for the attending institutions to deeply understand and effectively respond to the requirements of the new regulations.
Following the keynote speeches, the partners and attending guests engaged in enthusiastic and in-depth interactive exchanges during the tea break.
After the tea break, Llinks partner Mr. Jason Zhang delivered a speech titled "Five Asset Management Disputes, Five Unexpected Outcomes." Through five real-world cases, he deeply analyzed the legal risk points that are easily overlooked in asset management disputes. In addition, Mr. Zhang shared frontline judicial practice perspectives on hot issues such as the judicial determination of product risk ratings and the allocation of the burden of proof for suitability obligations.
Finally, Llinks partner Mr. Raymond Li, focusing on the cutting-edge topic of "New Challenges in Reputation Risk Management for Fund Companies in the AI Era," explored the novel reputation risks faced by fund companies against the backdrop of the rapid penetration of artificial intelligence technology. Mr. Li pointed out that the widespread application of AI technology in scenarios such as investment research assistance, customer service, and marketing content generation, while improving efficiency, also brings new risks such as information distortion, false content generation, and algorithmic bias. Combining the latest industry practices, Mr. Li provided systematic recommendations for fund companies to build a reputation risk firewall in the AI era, covering multiple levels including institutional construction, technical prevention and control, and crisis response plans.
