From October 25 to 26, 2025, the Second Shenzhen Legal Services Expo (the "Expo") was successfully held at the Shenzhen Convention and Exhibition Center. During the Expo's "Legal Services Guaranteeing Technological Innovation in Intellectual Property" exchange session, Ms. Cherri Che, Llinks partner and director of the Trade Secrets Professional Committee of the Shenzhen Bar Association, delivered a keynote speech titled "The Cornerstone of High Damages: Successful Litigation Logic and Compensation System Construction in Trade Secret Cases."
Ms. Che systematically analyzed the key path to achieving high damages in trade secret cases from three main dimensions: "Right Foundation Construction," "Infringement Evidence Chain Creation," and "Compensation Pricing Logic." Ms. Che pointed out that in the "Vanillin Case," the systematic construction of secret points, increasing from 17 drawings in the first instance to 185 in the second instance, demonstrated the significant advantage of "systematized secrets" in judicial determination. And in the "San Ao Case," a closed-loop infringement proof system was formed by constructing an evidence chain of "Illegal Acquisition—Illegal Use—Subject Correlation," laying a solid foundation for the court's finding of malicious infringement and high damages.
Regarding compensation calculation, Ms. Che emphasized the importance of the "combination strategy." Using the San Ao case as an example, she illustrated how presenting both the License Fee Appraisal Report and the Infringer's Sales Revenue in parallel helped persuade the court to adopt the high-damage claim. Additionally, Ms. Che provided an in-depth interpretation of the "activation elements" for punitive damages, noting that courts can apply punitive damages of up to five times the loss when both "malicious infringement" and "serious circumstances" are satisfied.
"Trade secret protection is not just about defense, but about building a system that is litigable, compensable, and enforceable," Ms. Che concluded. "Only by solidifying the right foundation, creating a closed-loop evidence chain, and using precise pricing logic can one gain the initiative and win high damages in litigation." Her sharing was comprehensive and featured typical cases, resonating widely with the attending lawyers and corporate in-house counsel.
