On February 18, 2022, Llinks Law Offices successfully held the "2022 Forum on Key Issues of Corporate Anti-Corruption" (the "Forum") at its Shanghai office. Legal counsels from a number of well-known Chinese and foreign enterprises were invited to the Forum, including pharmaceutical, chemical, manufacturing, financial, sports and entertainment, internet, and other industries. Llinks partners, Dr. David Pan, Mr. Bill Zhou, and Mr. Patrick Gu, as the keynote speakers, gave insightful presentations from the perspectives of substantive legal issues, investigation skills, post-investigation criminal charges, as well as post-investigation employee disciplinary measures. After the presentations, the presenters had a heated discussion with the guests on the relevant subjects. The Forum was co-organized by the GLOBAL INITIATOR CONSULTING GROUP ("GIC").
Dr. Pan shared on the topic of "Legal Issues in Anti-Corruption Law", focusing on the determination of commercial bribery, job embezzlement, and conflicts of interests. David elaborated on "penetration principle" and "influential third parties" in the area of commercial bribery, which is quite unclear in law enforcement. Dr. Pan also analyzed law enforcement focus of penalties on both bribe givers and recipients. Based on his rich experience in anti-corruption services, David opined on identification and evidence collection in common white-collar crimes like embezzlement and various types of conflicts of interests.
Mr. Zhou shared on the topic of "Criminal Charges Following Corporate Anti-Fraud and Anti-Corruption Investigations". Mr. Zhou explained the necessity of filing criminal charges and introduced the laws and regulations on criminal charges. Combined with his enriched practical experience, Mr. Zhou introduced several factors that may influence the outcome of criminal charges such as the complexity of the case, the victim's objects, and case filing procedures of public safety agencies. Mr. Zhou also made suggestions on improving chances of successful case reporting and on remedial measures in case of unsuccessful charges.
Mr. Gu shared with the guests on "Key Points of Anti-Corruption Investigation and Compliance on Disciplinary Measures". On the basis of the first two sessions, Mr. Gu further emphasized the importance of preparation and evidence presentation in anti-corruption investigations, shared important skills and key points of anti-corruption investigation interviews, as well as the difficulties of employee disciplinary measures, and gave practical suggestions on how to improve on disciplinary action clauses.
