On 21 July 2020, Civil Code and Data Utilization Academic Conference ("the Conference") was held in Koguan Law School by the Data Law Research Center of Koguan Law School of Shanghai Jiao Tong University, the Center for Artificial Intelligence Governance and Law of Shanghai Jiao Tong University, and the Civil Law Research Association of Shanghai Law Society. Llinks partner David Pan was invited to attend the conference and gave a speech on "Conflict between Subject's Consent and Data Utilization and Solutions". Dr. Pan started from the principle of informed consent in the speech, further discussed the limitations of informed consent as the sole legal basis and analyzed the conflicts arising therefrom, and finally proposed solutions to the conflicts in the view of systematic interpretation and comparative law.
The Conference was hosted by Professor Chengxin Peng, and addressed by Weidong Shi, Deputy Secretary of Party Committee of Shanghai Law Society and doubling as full-time vice president, and Professor Weidong Ji, a Changjiang Scholar from Law School of Shanghai Jiao Tong University. Also, scholars and specialists from Fudan University, Shanghai Jiao Tong University, Beihang University, Shanghai University, East China University of Political Science and Law, Tencent Group and other universities and institutions attended the Conference.
The topics of this Conference mainly include the Civil Code and data utilization, the Civil Code and data ownership confirmation, informed consent and notification rules of data utilization, data and platform governance. The Conference participants had detailed debates on the Civil Code and data utilization topic, and jointly explored whether the latest exploration of our Civil Code on the data related legal issues could provide sufficient legal basis to support data utilization in this digital age. During the conference, Dr. Pan and other participants had in-depth exchanges and discussions on each topic, and the Conference atmosphere was enthusiastic.
