3-6 December 2019, the "2019 Annual China Compliance Week" conference was held in Shanghai and Shenzhen. David Pan, partner of Llinks Law Offices, was invited to attend and give a speech, Felix Yin was invited to preside over part of the conference. There were three sessions of the "2019 Annual China Compliance Week", namely, "Anti-Corruption and Compliance Conference", "Anti-Unfair Competition Law Conference" and "China Cross-Border Compliance Conference". Professionals from well-known multinational companies and law firms from China, the united states and other countries engaged in the in-depth discussions on issues such as how technological innovation can improve the overall efficiency of legal compliance and how to promote anti-corruption and compliance management in China. More than 300 corporate executives, legal counsels, and compliance experts from around the world attended the conference.
On 3 December, 2019, at the "Anti-Corruption and Compliance Conference", Mr. Pan talked about how to promote anti-corruption and compliance management in China. Mr. Pan enumerated extraterritorial laws that are easily overlooked in corporate compliance, outlining the distinction between the liability of the corporation and individual's liability, the risk of third-party corruption, the phenomenon of "permafrost" in enterprises and the whistleblower system. He also explained how to formulate, implement and supervise anti-corruption compliance systems and how to carry out targeted trainings. In addition, Mr. Pan further analyzed the reasons for failure of anti-corruption governance in light of several typical cases that happened recently.
On 4 December 2019, during the "Anti-Unfair Competition Law Conference", Mr. Pan provided a thorough explanation on the motives, the statutory elements and the scope of parties targeted by commercial bribery through comparing definitions of "commercial bribery" under the new version and the old version of the Anti-Unfair Competition Law. Mr. Pan also provided practical suggestions on how to establish and improve enterprises' anti-commercial bribery compliance systems based on the relevant cases.
On 6 December, 2019, at the "China Cross-Border Compliance Conference", Mr. Pan delivered a speech titled "Addressing Compliance Issues on Data Transmission, Privacy and Cybersecurity in Cross-border Investments", in which he articulated relevant provisions of the GDPR regarding the practical application of the GDPR, personal data, sensitive personal data, protection of children's data and liability for violations. Furthermore, Mr. Pan compared regulatory regimes on data transmission of different countries such as EU, US and Russia etc., providing analysis on compliance issues regarding cross-border GDPR data transmission.
This event strengthened communications between compliance professionals. It is a beneficial exchange amongst lawyers practising compliance and anti-corruption laws in China.
