On 31 August, 2019, the second session of personal data rights protection forum was held at the Xuhui campus of Shanghai Jiaotong University. This forum was sponsored by the Data Law Research Center of Kaiyuan Law School of Shanghai Jiaotong University and the Shanghai Mana Data Technology Development Foundation. More than one hundred scholars, experts and representatives from Shanghai Jiaotong University, Renmin University of China, East China University of Political Science and Law, East China Normal University, Nanjing University, Zhejiang University, the Chinese Civil Law Society, the Institute of Chinese Academy of Medical Sciences, Alibaba, Huawei, and Bayer attended this forum.
During the forum, guest speakers shared their views on the following four topics: the definition of data, information and privacy rights; practical innovation in personal data rights protection; theoretical innovation in personal data rights protection; The above four sub-topics were deeply discussed, covering innovations in the protection of rights and interests of personal data in theory and practice, current legal and practical problems of personal data protection, and also exploring new ideas and new ways to strengthen the protection of personal data, development and utilization of all kinds of data in compliance.
Llinks partner, David Pan, was invited to deliver a speech on the Conflict between Protection and Utilization of Personal Information – "From the Perspective of Definition and Ownership". In his speech, he started by explaining the definition and ownership of personal information. He then analyzed the challenges to the protection and utilization of personal information caused by the absence of a broad legal definition and ownership rights of personal information, and then explored the benign balance between the two. Towards the end of forum, David Pan and other guests participated in an in-depth exchange and discussion which was well received.
