On 9 August 2019, Llinks lawyer Mr. Xun Yang was invited to attend the Future Summit on Medicine and Health 2019 and delivered a keynote speech on the Sharing and Protection of Medical Health Data. Over 300 corporate, technology and compliance experts from medical, pharmaceutical, health and IT service providers attended the summit.
Mr. Yang provided insight into the collection and use of personal medical information by medical institutions, research institutions and medicine manufacturers and distributors from macro perspective. He also pointed out the necessity to transfer personal medical and health information between relevant parties. Mr. Yang is of the opinion that the flow and sharing of medical information can play a greater role in the industry, however, in practice the isolation of information, the lack of a definition of information rights and a scattered supervision model hinder the flow of medical information. Mr. Yang then talked about the scope of right in medical data, privacy protection during information transfers and intellectual property sharing from a legal perspective.
Finally, Mr. Yang put forward a plan to establish an industry-wide health information platform, enabling cross-field medical information sharing and full commercial application of such information under the existing legal framework.
The discussion was well-received by the attendees. With information technology and big data widely applicable in medicine, the value of medical data is clear. Advanced technological solutions and innovated business patterns are emerging. Better protection rights related to medical and health data, more rigorous information security management, and more compliant data sharing mechanisms are issues that must be correctly addressed in the medical industry.
