On 22 June 2019, Llinks partner, Dr. David Pan was invited to attend the "Going Out" (i.e. overseas investment and/or operation) Compliance Theory and Practice Seminar organized by All China Lawyers Association (ACLA) in Beijing.

More than 120 representatives attended the seminar, including  ACLA Corporate Compliance Services Working Group members, practicing lawyers, corporate lawyers, government regulators and company representatives. Mr. Min Jiang, Deputy President of ACLA, addressed at the opening ceremony.

In the seminar, there were in-depth discussions on compliance policy interpretation and practical experience. Experts and scholars from the State-owned Assets Supervision and Administration Commission of the State Council and state-owned enterprises discussed about Compliance Management Guidelines for Central Enterprises and Compliance Management Guidelines for Enterprises' Overseas Operations. Moreover, there were five roundtable sessions during the seminar, the topics of which include enterprises building effective compliance management, lawyers providing compliance consulting services, overseas operation compliance, overseas employment compliance and overseas criminal compliance.

As the panelist for roundtable session of overseas operation compliance, Dr. Pan discussed the particularities of building overseas compliance system and the key considerations of overseas compliance operation with attendees at the session. Panelists shared their views that lawyers should integrate resources and work on systematic compliance construction and culture cultivation in the toughest fields with obvious problems. Meanwhile, enterprises should comply with the culture and legal systems of host countries when "going out" .

After one-day brainstorming, attendees all agreed that compliance is the premise for the overseas investment and operation of companies, and lawyers can help the companies with compliance consulting and construction. Lawyers should grasp the keys in the process of compliance legal services, so that they could better assist companies to develop well and steadily .
