Llinks Law Offices Partner Mr. David Wu was invited on 30 May 2019 to participate in the seminar on "Legal Risk Prevention and Dispute Resolution in the Entertainment Industry", sponsored by the China International Economic and Trade Arbitration Commission ("CIETAC") and co-sponsored by the China Television Drama Production Industry Association, Online Live Performance, China Association of Performing Arts and US Judicial Arbitration and Mediation Services (JAMS). Mr. Xu Chao (former Deputy Director of Copyright Department of National Copyright Administration of the PRC and Deputy Director of Beijing Justra Intellectual Property Center), Mr. Yang Qihu (General Legal Adviser of Tencent Music Entertainment Group), Mr. Li Wen (Legal Director of Huya Inc.), Mr. Liang Shan (Vice President of Online Live Performance, China Association of Performing Arts) and Mr. David Wu were invited to speak for the seminar. Nearly 60 professionals including government experts, university scholars, senior enterprise executives and lawyers from Chinese and international law firms participated in the seminar.
Mr. Wang Chengjie, Vice-President and Secretary-General of China International Economic and Trade Arbitration Commission delivered the welcoming speech. The seminar focused basically on two topics: New Legal Risks and Dispute Resolution in the Field of Entertainment, and Intellectual Property Dispute Resolution in the Entertainment Industry, on which the participants delivered speeches from their respective professional roles and experience. The seminar covered topics as performance of agency contracts, resolution of film and television program disputes, protection of online game enterprises, investment share repurchases, and the newly-developed live broadcasting issues. The seminar further explored the in-depth resolution of intellectual property disputes in various subdivisions of the entertainment industry.
Attorney Wu, as an arbitrator of Shanghai International Economic and Trade Arbitration Commission Arbitrator and Court of Arbitration for Sports, has long been providing legal services to well-known sports organizations and athletes, learning extensive experience in dispute resolution in the expertise of sports law. For this seminar, Attorney Wu gave his speech themed "Boundary between Entertainment Law and Sports Law", with the focus on the intersection and integration of entertainment and sports. He first analyzed the potential distribution and internal conflict of intellectual property rights of sports stars in crossover activities, i.e. allocable commercial rights of athletes under the existing framework, patterns of conflict between different sponsors, between athletes and sponsors, or between athletes and events, then put forward the measures to prevent conflicts in the corresponding industries. Attorney Wu further introduced the character of domestic and international sports law dispute resolution, presented his prospective over future trend of dispute resolution of sports, and proposed his idea to introduce external sports arbitration institutions and domestic commercial arbitration institutions.
