On 17 May 2019, "International Patent Strategy: Overseas Intellectual Property Risk Management of Chinese Enterprises" Seminar was held successfully at the law school of Fudan University. The seminar was co-organized by Intellectual Property Research Center of Fudan University, Shanghai Intellectual Property Magazine and JZMC Patent and Trademark Law Office. It aimed to discuss how to establish overseas intellectual property ("IP") risk assessment and defense mechanisms for Chinese enterprises; how to develop the operational models of international patent collective licenses; how to establish patent insurance systems and reasonable paths to evade and dissolve the overseas IP risks. Attendees included IP experts from Fudan University, in-house counsel and heads of IP departments of domestic and foreign telecommunications and high-tech enterprises, as well as partners of technology and IP practices from Chinese and foreign law offices.
Llinks lawyer Mr. Xun Yang was invited to attend the seminar and delivered a speech. Mr. Yang pointed out the difficulties and challenges to IP operations at the international stage for Chinese enterprises and he advised on the system construction and legal practice in relation to management of IP risks by taking into account the the differences between Chinese legal culture and foreign one.
Mr. Xun Yang further pointed out that Chinese enterprises' understanding about IP is different from the international common views. These differences are rooted in China's traditional legal cultures. Chinese enterprises tend to view IP as the representation of "advancement" than assets generating values. Chinese enterprises' partial understanding about "proprietary intellectual property rights" hinders them to make full use of IP assets by licensing and sharing of IP rights. Mr. Yang advised that protections of IP be reflected in every business activity throughout the business process from the early-stage until the completion.
Mr. Yang's speech was well received by participants and experts at the seminar. Over the past decade, Chinese enterprises actively go abroad to participate in the international market competition. Intellectual property risk management is a very important part of it.
