On 8 December 2017, Chengdu Shuangliu Free Trade Zone Administration and Hong Kong International Arbitration Center jointly organized the HKIAC Arbitration Clause Seminar and Expert Seminar. Llinks partner, Vincent Mu was invited to attend the seminar and participate in the negotiation exercise.
The theme of this event was "Free Trade with the Rules of Law under the cooperation between Chengdu and Hong Kong". It mainly conducted international arbitration clause negotiation exercises and judicial and enforcement seminars on foreign-related commercial arbitration, attracting more than 300 industry experts, scholars, and lawyers.
The simulated negotiation was a dispute between two enterprises from China and Indonesia over the implementation of the "Civil Aircraft Leasing Contract" and the "Civil Aircraft Maintenance and Maintenance Contract." As the representative lawyer of the Chinese enterprise, Vincent Mu started the negotiation from the angle of arbitration clause, such as the application of specific arbitration methods, the choice of arbitrators, the determination of arbitration language and the refinement of the clause language in order to find ways and means to resolve disputes.
It is learned that the negotiation of international arbitration clauses is a traditional project of the Hong Kong International Arbitration Center. It usually simulates the negotiation process of arbitration clauses in a foreign-related case. Both parties negotiate on the basis of dispute resolution, application of law, arbitration ground, choice of arbitration institutions and choice of arbitration rules, and ultimately maximize the protection of the interests of both sides.
