On June 4, 2026, the Global Biotechnology & Pharmaceutical Patent (China) Summit was held in Shanghai. More than 100 representatives from pharmaceutical enterprises, pharmaceutical service institutions, and intellectual property practitioners attended the forum. Llinks partner Mr. Xun Yang was invited to participate and moderated the roundtable forum on "Drug Patent Linkage System, Data Protection System, and IP Strategies for Pharmaceutical Companies."
The forum centered on how innovator drug companies and generic drug companies lay out their intellectual property under the patent linkage and data protection systems. Mr. Xun Yang moderated discussions on cutting-edge and controversial topics, including coping strategies for patent cliffs, the concurrence of patent linkage cases and subsequent infringement cases, and data dependency. In particular, Mr. Xun Yang conducted a three-dimensional cross-analysis combining drug review and regulatory policies (such as conditional marketing approval, the catalog of reference listed drugs, and volume-based procurement access) with patent linkage, data protection, and trade secrets, constructing implementable intellectual property layout schemes for enterprises at the complex interface of regulatory compliance and intellectual property protection.
In addition, from the perspective of cross-border BD transactions and the transparency of NewCo structures, Mr. Xun Yang converted institutional loopholes in patent linkage, the "implicit reliance" on data protection, and the "certainty paradox" of infringement standards into terms regarding transaction valuation, closing conditions, and risk allocation.
Mr. Xun Yang's moderation and insights received overwhelming responses from the attendees. As China's pharmaceutical R&D capabilities continue to strengthen and domestic drugmakers expand into global markets, strategic patent portfolio planning has become a critical priority for enterprises.
