On April 23, 2026, the Biopharmaceutical Innovators Forum was grandly held at the Zhangjiang Science Hall, bringing together over 300 top scientists, representatives from innovative enterprises, and experts from relevant investment institutions in the biopharmaceutical field. Llinks partner Mr. Xun Yang, attending as the sole representative from legal sector, was invited to deliver a keynote speech in English titled "Global BD Transactions—IP, Regulatory, and Cultural Matters."
Drawing on Mr. Yang's extensive practical experience and several recent transactions, Mr. Xun Yang provided an in-depth analysis of the current status, development trends, and underlying drivers of cross-border Business Development (BD) transactions. Mr. Yang further introduced the advantages of the NewCo and Co-co models. Combining theory with practice, he analyzed key legal issues in the BD process, such as information disclosure, intellectual property (IP) sharing and allocation, and data protection. In particular, he offered unique insights and practical recommendations regarding the ownership of rights for different components of biological drugs, IP issues arising from "industry-university-research" cooperation, and international multi-center clinical trial arrangements.
The presentation provided attendees with invaluable legal perspectives and practical suggestions, earning high praise from the gathered experts. With the rapid development of biopharmaceutical technology in China, many innovative enterprises have emerged on the international stage, achieving significant technological breakthroughs and actively engaging in international technical cooperation and licensing. In this process, properly strategic IP layout, reasonable allocation of IP rights and management responsibilities, precise definition of exclusivity scopes, and close monitoring of data flow restrictions have become critical issues that must be urgently addressed by enterprises.
