On 26 December 2024, the "Dispute Resolution in the Digital Economy Era Seminar" and the "Inauguration of the International Arbitration Court of Ganjiang New Area's Digital Economy Arbitration Centre" were successfully held. The event was organised by the International Arbitration Court of Ganjiang New Area the Data Law Research Institute of Jiangxi University of Finance and Economics, and Jiangxi Link & Cross Law Firm.
Llinks partner Dr. David Pan was invited to join the inaugural panel of experts for the Digital Economy Centre of t the International Arbitration Court of Ganjiang New Area. He presented a keynote speech on "Personal Information Definition, Ownership, and the Digital Economy", engaging in dialogue and exploration with the attending guests.
In his presentation, Dr. Pan began by elucidating the legal rights to personal information that individuals possess and the legal definition of personal information. He dissected the criteria for identifying personal information and delved into complex issues of personal information determination and anonymisation with the participants. Dr. Pan also discussed the balance between the advancement of the digital economy and data legislation policies, addressing the tension between the GDPR's stringent "notice-and-consent" authorisation model and China's innovative systems for promoting data circulation. He advocated for industry discussions on transitioning data protection frameworks from an exclusive focus on prior authorisation to allowing exceptions under specific conditions, with enhanced post-use security oversight and accountability.
The seminar gathered renowned experts across the country to deeply analyse and discuss cutting-edge topics such as amendments to arbitration laws, the evolution of the arbitration industry, arbitration disputes in the digital economy, resolution of data cross-border disputes, and the interplay between personal information and the digital economy. Over 60 industry experts, academic professors, and corporate representatives from various regions were in attendance.
