On December 22, 2023, the "Forum on Compliance and Development of Data Element Circulation" was successfully held at the Xuhui Campus of Shanghai Jiao Tong University. Mr. David Pan, the partner in charge of data business at Llinks, attended as an expert in the field and shared professional insights from the perspective of data compliance practices during the roundtable discussion.
The Forum was hosted by the Data Law Research Center of Koguan Law School of Shanghai Jiao Tong University and the Civil Law Research Association of Shanghai Law Society("SLS"). Professor Peng Chengxin, Dean of Koguan Law School and Director of Data Law Research Center, presided over the opening ceremony of the Forum. Mr. Shi Weidong, Vice President of SLS, delivered a speech at the opening ceremony. Mr. Shi Weidong highly appreciated the topic selection for this Forum, stating that "without data circulation, there will be no development, and without data compliance, there will be no development." How to balance the relationship between security and development in data circulation is a problem that the brand new era of data has called for the talents in the field to jointly discuss and resolve.
Professor Peng Chengxin continued to host the keynote speech segment of the Forum. After the keynote speech segment, Mr. David Pan, a partner of Llinks, took over the roundtable discussion segment.
In the roundtable discussion session, Mr. David Pan gave a presentation on "Difficulties we met in Data Element Circulation Compliance Practice". He elaborated on the following three aspects: how to correctly understand the relationship between data compliance and data circulation, how to view data compliance work from the perspectives of regulators and enterprises, and how to solve prominent problems in current data compliance practices. From the perspective of cost-benefit economic analysis, he focused on discussing the advantages and disadvantages of the one-case-one-trial system for regulatory authorities and its relationship with the efficiency of data element circulation. He emphasized that data compliance should balance security and development, rather than solely focus on security.
The Forum has gathered more than 20 experts and scholars from Shanghai Jiao Tong University, Fudan University, East China University of Political Science and Law, Beijing Institute of Technology, China Advertising Association, China Academy of Information and Communications Technology, Shanghai Cyberspace Affairs Commission, Shanghai Digital Commerce Association, Tencent Group, Pinduoduo, and other research institutions, industry agencies, internet companies, and law firms, promoting an in-depth discussion on the value release and compliance governance of data elements.
