On September 22, 2022, Llinks successfully held the 2022 the Fourth Commercial Intellectual Property Forum in Shanghai.
This forum closely tracked the business issues related to intellectual property rights. Xun Yang, James Wang and Mark Zhang and Nora Wu delivered keynote speeches and discussed the topics with guests.
At the beginning of the forum, Xun Yang Esq. reviewed the development of the intellectual property legal system and practice from 2021-2022, introduced the background of strengthening intellectual property protection in China from a macro perspective, and reviewed the development of the IP legislation and of the latest judicial practice from three aspects: the increase in compensation for intellectual property infringement, the implementation of the pharmaceutical regulatory approval and patent linkage, and the development of intellectual property protections on data.
Then, under the title of "the Selection and Protection of New Business Models, from Typical Competition Dispute Cases", James Wang Esq. analyzed the unfairness and culpability of the behaviors in new business model lawsuits with two classic cases: the first platform ecological litigation case and the first manual volume brushing platform case in China, which brought enlightenment to the guests on the selection, protection, boundary and other issues of the new business model.
Afterwards, Xun Yang Esq. brought insights on "the Prevention of Intellectual Property Risk in Technology Transactions and Technical Cooperation". Taking reference to his previous practical cases, he provided relevant insights on the contractual risks in technology transactions. Taking the cooperation with part-time researchers and independent researchers as the starting point, he discussed the intellectual property risk in IUR. Then he introduced risk management and control in the whole process of technology transactions and discussed the main problems of technology investment.
After the tea break, Mark Zhang Esq. presented "the Analysis in Strategy of and Response in Intellectual Property Infringement Litigations". He outlined three aspects of intellectual property infringement litigation, including the collection and preservation of evidence; the common practices before litigation and procedural issues in litigation. He probed into the issues of evidence collection, rights protection, jurisdiction, behavior preservation and confirmation of non-infringement in patent litigation, showing that although limited in litigation means, the strategies are unlimited in intellectual property litigation.
At last, Xun Yang Esq. and Nora Wu Esq. selected the topic of "trade secrets" and delivered a speech on "Risk Mitigation and Establishment of Protection System for Trade Secrets". Through the enlightenment in litigation cases related to trade secrets, they thoroughly discussed the burden of proof in business secrets, as well as the management and compliance requirements for a company's business secrets. Especially, they put forward suggestions for companies to establish an internal business secret management system.
