On June 24, 2022, the 35th meeting of the Standing Committee of the 13th National People's Congress voted to pass the newly revised Sports Law of the People's Republic of China (hereinafter referred to as the "New Sports Law"). Effective on January 1, 2023, the New Sports Law clearly promotes the construction of a 'leading sports nation' and a healthy China, implements the "Strengthening Sports for Development Strategy" and program, gives priority to the development of youth and school sports, supports the development of sports industry, establishes a sports arbitration system and so on.
Recently, Llinks partner Mr. David Wu was interviewed by 'Great Sports' Channel of Shanghai TV Station to interpret the New Sports Law. As to the relevant contents of the chapter on teenagers and schools in the New Sports Law, Mr Wu said that in the past, schools may restrain sports activities for safety concerns. However, since now physical education is included in more important examination subjects, schools should focus on high-quality physical education classes while ensuring the safety of students, which will have a positive effect on the physical quality of students. Mr. Wu believes that this revision will contribute to the sustainable, high-quality and stable development of youth sports in China in the future.
Mr. Wu is also an arbitrator of the International Court of Sports Arbitration. In the interview, he says that the revision to the sports arbitration system is a perfection of the sports system and a protection of various aspects of the sports industry. He illustrates in the interview that the sports arbitration in the New Sports Law includes the establishment of sports arbitration institutions, the scope of jurisdiction of sports arbitration, and the jurisdictional differences between sports arbitration, general commercial arbitration and labor arbitration. According to Mr. Wu, the establishment of sports arbitration is to ensure the completeness of the whole sports system, protect and govern the legitimate rights and interests of all parties such as athletes, investors, sports clubs, associations, and administrative departments in accordance with relevant laws and regulations.
The revision of the Sports Law is a milestone in the development of China's sports industry and represents the fruit of the joint efforts of generations of legal experts and many professionals in the sports industry. Mr. Wu is honored to participate in the earliest drafting of the sports arbitration chapter in the New Sports Law, and commits to continue to contribute to the construction of the rule of law in sports in China in the future.
