On November 1, 2021, Seminar on Cyber Security • Data Security • Personal Information Protection Law Practical Issues a.k.a. Book Launch Conference of the Blue Book of PRC Cybersecurity and Data Compliance: Insights and Practices in 2021-2022 jointly organized by Llinks Law Offices and Wolters Kluwer was successfully held in Llinks Law Offices, Shanghai. On the day when the Personal Information Protection Law came into effect, legal professionals from a number of well-known domestic and foreign companies and industry colleagues were invited to the Book Launch Conference to witness the publishing of the latest works of Llinks Compliance Team, the Blue Book of PRC Cybersecurity and Data Compliance: Insights and Practices in 2021-2022. At the same time, Llinks Compliance Team discussed in-depth about the legal environment under the three laws of the Cyber Security Law, the Data Security Law, and the Personal Protection Law, precisely addressed unresolved problems in legislations, integrated law enforcement and compliance practices, put forward practical compliance implementation solutions for attendees. David Pan, Xun Yang, Nigel Zhu, Jianqi Yang and Susan Deng attended the Book Launch Conference and shared relevant topics.
At the beginning of the Book Launch Conference, David Pan gave a speech on the topic Quick Overview and Key Points of the Cyber Security Law, the Data Security Law, and the Personal Protection Law. David provided participants with a quick overview of core laws and reminded participants of focus of recent law enforcement. David also summarized difficult issues on data compliance, including the establishment of enterprises' internal systems, the data classification and grading protection system, regulations on and practices of cross-border data transfer, and key points of processing personal information, and put forward practical rectification suggestions. David received wide praise from the participants.
Later, Nigel Zhu gave a speech on the topic Talks on Protection of Personal Information Rights and Interests from the First Case of Big Data Discrimination. Through the latest practical cases, Nigel brought participants first-hand information on litigations in the field of data compliance. Nigel clearly and thoroughly explained the complex practical cases, focused on legal risks of and juridical practice on big data discrimination, guided participants to look forward to protection of personal information rights and interests under the Personal Information Protection Law, and brought cutting-edge insights to participants.
In the afternoon, topics of the seminar were under hot discussion. Xun Yang shared with participants analysis of compliance hotspot in the digital age. Xun Yang gave a speech entitled Are You Ready for the Digital Age. Taking opportunities and challenges of enterprises in the digital age as the background, and focusing on digital regulation, digital network, digital terminal and digital governance, Xun Yang discussed in-depth on difficult issues such as law enforcement principles and strategies in the new environment, freedom of and restrictions on data flow, compliance risks of APPs and legal countermeasures, unfolding what compliance should be in the digital age.
Subsequently, Jianqi Yang shared a topic on 6 Hot Issues of Consent under the Personal Information Protection Law. Jianqi interpreted important legal terms of consent, implied consent, separate consent and withdrawal of consent thoroughly and step-by-step, distinguished the relations between separate consent and legal basis for processing other than consent, proposed a solution where recordkeeping of consent is a substantial element, providing participants with hands-on compliance solutions.
Finally, Ms. Susan Deng gave a speech entitled Key Tips for Cross-border Data Transfer and Q&A. Susan carefully selected the hot topic of data export, and delivered solutions for global system deployment and data export by explaining the legislation background of data localization and restrictions on data export. Susan also discussed about restrictions on export of specially-regulated data and extraterritorial law application, presenting practical focuses of data export from multiple perspectives.
The Blue Book of PRC Cybersecurity and Data Compliance: Insights and Practices in 2021-2022 launched in this conference is the latest summary of practical and theoretical achievements of Llinks Compliance Teams.
