On July 29, 2021, Llinks and LCOUNCIL successfully co-held a seminar and roundtable forum on the topic of 'Compliance in Digital Economy' at Llinks Shanghai office. Numbers of in-house counsels from well-known domestic and overseas enterprises, covering pharmaceutical, chemical, manufacturing, finance and other industries, were invited to attend the event.
The forum focused on the hot issue of 'data compliance'. Heated discussion was raised from legislative context analysis to practice cases, as well as from data rights protection to data violation risks during the forum.
David Pan, a partner of Llinks, Xun Yang Esq. as well as other lawyers and experts attended the forum and made presentations.
Mr. Pan made a clear introduction on China's current data legislation system by refining the key points in 'Data Security Law' and 'Personal Information Protection Law' and analyzing the practical risks in data compliance under the title of 'Panoramic Overview and Key Notices of Data Security Law and Personal Information Protection Law'.
Focusing on the issue of 'Intellectual Property Rights and Unfair Competition in the Digital Economy', Xun Yang Esq. started with pointing out the ownership and category of data, and then analyzed the data rights and interests from the perspective of copyright and trade secrets, taking 'data rights', 'system rights' as starting points. He also introduced the composition of the system, and emphasized 'system rights' from the perspective of software copyright.
In the second-half of the forum, Mr. Nigel Zhu, Mr. Jianqi Yang and Ms. Susan Deng, who have profound practice experience in cybersecurity and digital compliance, had an in-depth discussion with participants about a variety of vital issues including 'data integration', 'data leakage', 'cybersecurity inspection' and etc. Combined with their own practice experience and theoretical research, experts and lawyers attending the forum shared their valuable legal insights, which was well received and praised by the participants.
