On May 23, 2021, the "Experts Seminar on the 2nd Draft of Personal Information Protection Law" (the "PI Law") jointly sponsored by the Law School of Tongji University and Internet and Shanghai Branch of Information Law Research Society of China Law Society, as well as the Internet and AI Law Research Center of Law School of Tongji University, was held in Siping Road Campus of Tongji University. Experts discussed the revision and development in the 2nd Draft of the PI Law from several aspects on the seminar, including the relationship between the PRC Civil Code and the PI Law, whether the "responsibility inversion" clause will render the personal information processor take excessive burden of proof, the boundary of "reasonable scope" when processing personal information in public domain; whether there shall be restrictions when personal data subjects withdraw their contents; practical issues related to the cross-border transmission of personal and data retrieval in the international cooperation. Llinks partner David PAN, and Llinks lawyer Jianqi YANG were invited to attend this expert seminar. According to their practicing experience, they discussed (1) how the 2nd Draft enhanced the protection of personal data subjects' interests and (2) how the 2nd Draft ensures the security of data flows on the seminar. Participants discussed with Mr. PAN and Mr. YANG in-depth on practical questions that personal data processor may confront. The speech was well received by the experts and other participants.
