On April 12, 2021, Llinks Technology Law Expert Mr. Xun Yang was invited by Shanghai Foreign Investment Association to deliver a speech about the Biosafety and Human Genetic Resources Protections to legal counsels and executives of multinational life science companies.
Mr. Yang discussed the risks companies face when performing researches involving human genetic resources. Mr. Xun Yang discussed the following issues citing practical cases: (1) key compliance points under the Biosafety Law; (2) regulatory matters in relation to human genetic resources; (3) personal information protections for human genetic resources; and (4) intellectual property protections for human genetic resources.
Participants discussed with Mr. Yang in-depth on practical questions that pharmaceutical companies confront frequently regarding human genetic resources, including the scope of the "human genetic resource" and the definition the "foreign entity", the Biosafety Law's potential impact on pharmaceutical companies, the access to, usage and export of personal data, etc..
The speech was well received by participants. Our government is paying increasing attentions on protections and supervisions on human genetic resources. Life science companies must prepare to meet ever-changing regulatory requirements and adjust their risk management strategy to ensure that their clinical trials and R&Ds in China are in compliance with the latest laws and regulations.
